Companies with more than 100 employees must publish a Salary Transparency and Remuneration Criteria Report, as mandated by the Ministry of Labor and Employment (MTE). This requirement is established by Law No. 14,611/2023 and regulated by Decree No. 11,795/2023, with a focus on promoting equal pay for women and men in the corporate environment.
A report must be prepared containing information on the remuneration criteria used by companies, the existence of job and salary plans, as well as the implementation of initiatives aimed at gender equality. The data is consolidated by the MTE based on information provided on the Emprega Brasil portal, as well as records extracted from the RAIS (Annual Report of Social Information).
Milene Gregores, senior attorney at MMADVS, explains that "the publication of the report is mandatory and must be done on companies' communication channels, such as institutional websites and corporate social media, in a location visible to employees and third parties." According to her, failure to comply with this requirement may result in an administrative fine equivalent to 3% of the payroll, capped at 100 times the minimum wage.
The lawyer also added that "companies must be attentive to the accuracy of the information they report, as the data will serve as a basis for inspections and actions by regulatory agencies, such as the Public Ministry of Labor." Furthermore, the report can be used by labor unions and other social actors to monitor gender equality policies in labor relations.
Preparing the document can also represent an opportunity for companies to review their pay practices and adopt inclusion and diversity measures. Monitoring legislation and seeking specialized legal guidance are recommended to ensure compliance with legal requirements.
