New CLT rule: employees are entitled to three days of paid leave to receive vaccination

Since April 2026, a new labor regulation requires Brazilian companies to inform employees about vaccination and to grant up to three days of paid leave per year for preventive health screenings. This change, enacted by President Luiz Inácio Lula da Silva, introduces Article 169-A into the Consolidation of Labor Laws (CLT).
The objective is to ensure that all employees have access to information about vaccination campaigns and can take care of their preventive health without financial loss.
The new legislation aims to raise awareness among workers about the importance of vaccination and preventive healthcare. Companies are required to promote awareness campaigns on diseases such as HPV and various types of cancer, in line with guidelines issued by the Ministry of Health.
Employees are entitled to be absent from work for up to three days every twelve months for preventive examinations, with legal protection and full pay maintained.
Challenges
The implementation of this policy presents both challenges and opportunities. Companies will need to adjust operations and may need to provide training to ensure proper communication of the new requirements.
However, these measures are expected to improve employee well-being and reduce health-related absenteeism.
With the law already in force since April 2, 2026, the next step for companies is to ensure full compliance with the new regulations.
